As noted above, pardos and even morenos could be free in the Spanish Empire, I'd guess from pretty early days. English law tended to harmonise with Spanish in that era and location -- partly as a matter of convenience, and partly because there was a shared notion of the Respublica Christiana -- Western Imperium -- and both sides acknowledged a part in that, in legal and political theory. (See Carl Schmitt, Nomos of the Earth for more detail on the legal background, from a perspective that speaks to Fascism perhaps more than your typical treatment). The general notion was the European Kings were Caesars ('king's), relative to a hypothetical empire, which could in principle could have Augusti ('emperors'). There were, of course, disputes over who could be the Emperor and of course whether the Hapsburgs and Bourbons even qualified. (The Spanish Armada and the Reformation were a bit of sore point here). However, there were still shared legal and political principles that defined 'International Law' and were shared among the various states -- and have been recently overthrown by Communists and Jews, in seeking a European Super-State they can bend to their will.
